Justin Sewell is seeking permission from the Supreme Court of Canada to appeal his sentence.

In October, BC’s highest court overturned his conditional sentence, ruling he must serve prison time.

The Supreme Court is expected to decide by mid-2026 whether his appeal can proceed.

Sewell’s request for bail while awaiting the decision was denied, keeping him in custody.

A veterinarian, he pleaded guilty to one count of sexual assault and two counts of voyeurism for crimes committed in 2007, when the victim lived with him, his wife, and their children. Court documents say he secretly added drugs to her drink, assaulted her, and took nude photos, as well as photographing her through her bedroom window on other occasions.

Initially sentenced to less than two years in total—allowing for community service—the appeal court ruled it was wrong for the sentences to run concurrently.

Sewell pleaded guilty early in the process, according to the Appeal Court.
